Kaveh Kermanshahi, Campaign Activist and Human Rights Defender, Sentenced to Five Years in Prison

Change for Equality: Kaveh Ghasemi Kermanshahi a well known human rights defender and a women’s rights and Campaign activist was sentenced by Judge Moradi, of the the 1st Branch of the Revolutionary Courts in Kermanshah, to a 5 year mandatory prison terms, to be served in Dizelabad prison in Kermanshahd.

Prior to the ruling, Kermanshahi had been tried in a two part hearing on the charges of actions against national security through membership in the Organization to Defend Human Rights in Kurdistan [Iran] and spreading of propaganda against the state through publication of news, reports and interviews with the media, as well as having relations with the families of prisoners and executed or killed political activists.

The sentence was served not in writing but orally to Mostafa Ahmadian the lawyer representing Kermanshahi. Referencing Articles 499 and 500 of the Islamic Penal Code, Kermanshahi was sentenced to the highest level of punishment allowed under these articles. Additionally, in an unprcendented ruling the court decided that Kermanshahi’s passport and other personal documents, as well as all the materials confiscated by authorizes, including Kermanshahi’s personal computer, mobile phone, camera and printer should be seized by the government as instruments facilitating crimes.

According to Mostafa Ahmadian, the lawyer representing Kermanshahi, the sentence of 5 years mandatory imprisonment explained that: “this sentence was unexpected for me and for my client as well and a heavy sentence indeed. None of the actions of my client, which were carried out with humanitarian intents, satisfy the conditions of actions against national security or the spreading of propaganda against the state.”

Admadian continued further by explaining that he would appeal the ruling and hoped that the courts would act more fairly in the appeals process with respect to the case brought against his client. Kaveh Kermanshahi was arrested on February 3, 2010 and released on 100 Million Tomans Bail (roughly $100,000) on May 22, 2010.
